Terms of Service

These Terms of Service ("Terms") govern your use of the deariary service operated by deariary ("we", "us", or "our"). By accessing or using deariary, you agree to be bound by these Terms.

1. Description of Service

deariary is an automated diary generation service. We collect data from your connected external services and use large language models (LLMs) to generate daily diary entries on your behalf.

Diary entries are generated by AI and may contain inaccuracies, omissions, or hallucinations. We do not guarantee the factual accuracy of generated content. You are responsible for reviewing entries before sharing them.

2. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 16 years old to use the service
• You may create multiple accounts for different purposes (e.g., work diary and personal diary), but creating multiple Free accounts to circumvent plan limitations is prohibited
• You must not share your account with others

3. Acceptable Use

You agree not to:

• Use the service for any illegal purpose
• Attempt to gain unauthorized access to the service or its systems
• Interfere with or disrupt the service or other users' use of the service
• Attempt to reverse-engineer, decompile, or extract the source code of the service
• Use the service to generate content that is harmful, abusive, defamatory, or infringes on the rights of others
• Use automated tools (bots, scrapers) to access the service, except via the Public API
• Circumvent rate limits, usage quotas, or other technical restrictions

4. Connected Services

• You authorize deariary to access data from the services you connect
• You are responsible for ensuring you have the right to share data from connected services with deariary
• We only access data necessary for generating your diary entries
• You can disconnect any service at any time from your account settings
• If an OAuth token expires or is revoked, we will notify you and stop collecting data from that service

5. Content and Ownership

• Your data: You retain full ownership of all diary entries and data associated with your account
• Generated content: Diary entries generated by deariary are your property. You are free to read, publish, share, export, or delete them
• Data format: Data is stored as Markdown and YAML. You can export your data at any time (see section 13)
• License to us: You grant us a limited, non-exclusive license to process your data solely for the purpose of providing the service. This license terminates when you delete your account
• Shared entries: When you share a diary entry via link, the content is accessible to anyone with the link. You are responsible for what you share publicly

6. Intellectual Property

• The deariary service, including its software, design, branding, logos, and documentation, is the intellectual property of deariary and is protected by applicable copyright, trademark, and other intellectual property laws
• These Terms do not grant you any right, title, or interest in our intellectual property
• You may not copy, modify, distribute, or create derivative works based on any part of the service without our prior written consent
• "deariary" and associated logos are trademarks of deariary. You may not use them without prior written permission

7. AI-Generated Content Disclaimer

Diary entries are generated by third-party LLM providers (OpenAI, Anthropic, Google). As such:

• Entries may contain factual errors, hallucinated details, or misinterpretations of your data
• We do not review, edit, or verify generated content before delivery
• You are solely responsible for the accuracy of content you publish or share
• We are not liable for any consequences arising from inaccurate AI-generated content

8. Plans and Pricing

• Prices are listed in USD
• Japanese Yen (JPY) pricing is available for users residing in Japan: Basic ¥800/month (¥8,000/year), Advanced ¥1,600/month (¥16,000/year)
• Paid plans are billed monthly or annually via Stripe
• Annual plans include 2 months free
• Prices may change with reasonable advance notice via email
• Refunds are handled on a case-by-case basis; contact support@deariary.com

9. Free Plan Limitations

The Free plan includes:

• Daily diary generation with 1 connected integration
• 30 days of diary history (older entries are not deleted but become inaccessible until you upgrade)
• All diary formats
• Link sharing
• Data export

The Free plan does not include:

• Weekly and monthly summaries (Basic and above)
• LLM model selection (Free plan uses a standard model; paid plans offer additional models)
• Public API and Webhook access (Advanced only)
• Priority support (Advanced only)

10. API and Webhook Usage

• Access to the Public API and Webhooks is subject to rate limits and usage quotas as described in the API documentation
• We reserve the right to suspend or revoke API access at any time if we determine, in our sole discretion, that your usage is abusive, excessive, or in violation of these Terms
• API keys are confidential and must not be shared publicly. You are responsible for all activity under your API keys

11. Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted service
• We may perform scheduled maintenance with prior notice when possible
• We are not liable for any downtime, service interruptions, or data loss caused by events beyond our reasonable control

12. Service Modifications and Discontinuation

• We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice
• This includes adding, changing, or removing features, integrations, plans, or pricing tiers
• We will make reasonable efforts to notify users in advance of significant changes
• We are not liable to you or any third party for any modification, suspension, or discontinuation of the service

13. Data Export and Portability

• You can export your diary entries at any time in Markdown + YAML format
• Export is available on all plans, including the Free plan
• You can export your data before deleting your account
• Exported data does not include raw source data from connected services (due to third-party terms of service)

14. Account Termination

• By you: You may delete your account at any time from your account settings
• By us: We may suspend or terminate your account if you violate these Terms
• Data deletion: Upon termination, your data will be permanently deleted within 30 days (see our Privacy Policy for details)
• Subscription: Your subscription will be cancelled and no further charges will occur
• Export: You can export your data before termination

15. Content Removal

• We reserve the right to remove or disable access to any shared diary content that violates these Terms, applicable law, or the rights of third parties
• We may remove content without prior notice in urgent cases (e.g., illegal content, privacy violations)
• We are not obligated to monitor shared content but may do so at our discretion

16. Limitation of Liability

• The service is provided "as is" without warranties of any kind, express or implied
• We are not responsible for the accuracy, completeness, or reliability of AI-generated diary content
• Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim
• We are not liable for indirect, incidental, special, consequential, or punitive damages
• We are not liable for any loss arising from third-party service outages, API changes, or OAuth token revocations

17. Force Majeure

We are not liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power or internet outages, or failures of third-party infrastructure or service providers.

18. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the service, your violation of these Terms, or your publication of AI-generated content.

19. Changes to Terms

We may modify these Terms at any time. For significant changes, we will:

• Post the updated Terms on this page
• Notify registered users by email with reasonable advance notice before the change takes effect

Your continued use of the service after the effective date constitutes acceptance of the modified Terms. If you do not agree, you may delete your account.

20. Governing Law and Dispute Resolution

These Terms are governed by the laws of Japan. In the event of any dispute arising from these Terms or the service, both parties agree to first attempt to resolve the dispute through good-faith consultation. If the dispute cannot be resolved through consultation, it shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

21. Assignment

You may not assign or transfer your rights or obligations under these Terms to any third party without our prior written consent. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets, without your consent.

22. Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by us.

23. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and deariary regarding the use of the service, and supersede all prior agreements, communications, and understandings.

24. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
